Terms of Service

1. Overview

These Terms govern your access to and use of SketchDuck, a browser-based design tool operated by the SketchDuck team (“SketchDuck”, “we”, “us”). By using the service you agree to these Terms and the Privacy Policy. If you do not agree, please do not use the service.

2. Service Description

SketchDuck provides free tools for creating thumbnails, social images, and other graphics. No account is required; projects are stored in the user’s browser. We may update, suspend, or discontinue parts of the service at any time with or without notice.

3. Eligibility & Usage

• You must be at least 13 years old or have parental consent.

• You are responsible for the security of your device and browser.

• You may not use the service for unlawful, defamatory, or discriminatory purposes.

• You must respect the intellectual property and privacy rights of others.

• Automated scraping, reverse engineering, or attempting to gain unauthorized access is prohibited.

4. Intellectual Property

• User-generated content: You retain ownership of designs you create. You grant SketchDuck a limited license to host and display such content solely to operate the service on your device.

• Service assets: Templates, icons, and UI elements provided by SketchDuck remain our property or that of our licensors.

• Template usage: You may use built-in templates for personal or commercial design projects, but you may not resell or redistribute the templates or editor itself.

5. Data & Storage

Projects live in your browser’s local storage. SketchDuck does not guarantee backup or recovery. Clear your cache or switch browsers and the data may disappear. Export important work as image files to retain copies.

6. Advertising and Third Parties

We may display ads (e.g., Google AdSense) to keep the app free. Ads are served by third parties subject to their own terms. External links are provided for convenience; we do not control their content.

7. Fees

SketchDuck currently offers its core features for free. We may launch optional paid plans or premium assets later; any such changes will be announced in advance.

8. Warranty Disclaimer

The service is provided “as is” without warranties of any kind. SketchDuck disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, SketchDuck will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities. Our aggregate liability for any claim will not exceed USD $10 or the amount you paid us in the preceding 12 months (whichever is greater).

10. Indemnification

You agree to indemnify and hold harmless SketchDuck and its affiliates from any claims arising out of (a) your use of the service, (b) content you create or upload, or (c) your violation of these Terms or another person’s rights.

11. Termination

We may suspend or terminate your access at any time if we believe you have violated these Terms or harmed the service. You may stop using the service at any time by closing your browser; project data stored locally will remain on your device until you remove it.

12. Changes to These Terms

We may update these Terms when we add features or respond to legal requirements. We will update the “Last Updated” date and may post a notice in-app. Continued use of the service after changes become effective constitutes acceptance.
